Medical accidents charity ponders judicial review bid

Opponents of the government’s Legal Aid, Sentencing and Punishment of Offenders Bill could launch another High Court challenge.

Action against Medical Accidents (AvMA) will decide this week whether to seek a judicial review to counter the removal of legal aid for clinical negligence cases.

Chief executive Peter Walsh said AvMA will proceed in seeking a judicial review if there is no response from the government to its letter before claim.

He said: ‘The proposal is irrational and unfair – we’ve seen from some of the debates in parliament that politicians on all sides support that view.’

The threat comes in the same week as the Spinal Injuries Association was denied permission to launch a judicial review against the MoJ over the way the government consulted on the Jackson reforms.
