A fund of last resort for workplace injuries must be introduced by the Government to end an “unfair subsidy” of insurers, APIL has said in a leading trade publication.
In an article for New Law Journal, vice-president Karl Tonks said that the existing system of tracing insurers for cases of longtail disease, such as mesothelioma, has “failed too many people”.
An injured worker is left subsidising an insurance company when he cannot bring a case because it is not possible to trace his employer or his employer’s insurer.
Karl called for a fund of last resort, also known as an employers’ liability insurance bureau (ELIB) to be set up and paid for by insurers as they “have been able to avoid providing proper redress for many claims over the years”.
Karl wrote: “The Association of British Insurers (ABI) has said previously that ‘insurers remain fully committed to paying fair compensation claimants as quickly as possible’. However, the insurance industry has not matched these fine words with sufficient action”.
